Please read these terms and conditions carefully before using Our Service.
These Terms & Conditions (“Terms”) govern the online fitness coaching services (“Services”) provided by Leo Alves (“I,” “me,” or “Coach”) to you (“Client”). By purchasing and/or participating in these Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Scope of Services
Online-Only Coaching: I deliver fitness coaching services entirely online. All communication, workout plans, and nutritional guidance are provided digitally (e.g., through email, online platforms, and in some cases, video calls).
Individualised Support: I tailor workout and nutrition advice to each Client’s goals, schedule, and lifestyle. However, my Services do not replace medical or other professional healthcare advice.
2. Membership Options
4-Week Recurring Membership: Recurring billing occurs every 4 weeks. This membership automatically renews unless cancelled, as outlined in Section 5.
12-Week Recurring Membership: Recurring billing occurs every 12 weeks at a discounted rate. This membership automatically renews unless cancelled, as outlined in Section 5.
3. Payment and Billing
Automatic Payments: By enrolling, you authorise me (or my designated payment processor) to charge your chosen payment method on a recurring basis (every 4 or 12 weeks, depending on your plan).
Fees and Currency: All fees are quoted and charged in GBP (Great British Pound) and may be subject to exchange rates, applicable taxes, or transaction fees.
Money-Back Guarantee: If you feel that 1-2-1 online fitness coaching isn’t for you, you can request a full refund within the first 10 days of signing up. After this period, no refunds will be issued for the current billing cycle.
Refunds: Due to the nature of digital coaching and individualised program creation, all payments beyond the initial 10-day window are final. No refunds will be issued for unused portions of membership, including cases where a Client fails to communicate (see Section 6).
4. Service Delivery
No In-Person Sessions: All coaching is delivered online via email or messaging platforms. Video may be used in some instances, but there are no in-person sessions.
Plan Adjustments: I may adjust workouts or nutritional advice based on Client feedback, progress, or changing goals, provided the Client communicates needs in a timely manner.
5. Cancellation and Renewal
Automatic Renewal: Both 4-week and 12-week memberships automatically renew at the end of each billing cycle.
How to Cancel: You may cancel at any time by providing written notice (e.g., email) at least 3 days before your next billing date. Cancellation requests received after this time may result in another billing cycle charge.
No Partial Refunds: Cancelling stops the next billing cycle, but no prorated refunds are provided for the remaining period of the current cycle.
Refunds After Billing: If your membership renewal has already been processed and you request a refund because you forgot to cancel beforehand, a full or partial refund is not guaranteed. This is due to taxes and processing fees that may already have been incurred. Any decision regarding refunds under these circumstances is at my discretion and may result in a reduced or no refund.
6. Client Responsibilities & Communication
Active Participation: To see results, Clients must engage with the provided workouts, nutritional guidance, and check-ins.
Lack of Communication: If a Client becomes unresponsive (i.e., consistently fails to reply to check-ins or outreach), no refunds will be issued for unused services within that billing cycle.
Honesty & Accuracy: Clients must provide accurate personal information (e.g., health status, schedule) to ensure safe and effective coaching.
7. Medical Disclaimer
Consult a Physician: My coaching does not replace medical advice or treatment. I strongly recommend that Clients consult a qualified healthcare professional before starting any new exercise or nutrition plan.
Assumption of Risk: Clients acknowledge that any fitness activity involves inherent risks. I am not liable for any injuries or health conditions resulting from implementing the advice provided.
8. Intellectual Property
Ownership: All materials—such as workout plans, nutritional guidelines, and related content—are my intellectual property.
Personal Use Only: Clients may use these materials for their personal use and may not copy, distribute, or resell them without my written consent.
9. Privacy and Confidentiality
Client Information: I respect your privacy. Any personal information, progress data, or feedback shared by Clients will remain confidential unless disclosure is required by law or explicitly authorised by the Client.
Testimonials and Success Stories: I may request permission to share results or progress updates for marketing or promotional purposes but will only do so with explicit Client consent.
10. Limitations of Liability
No Guaranteed Results: While I provide structured guidance, individual results will vary based on factors like your effort, consistency, communication and personal health.
Release of Claims: By participating, Clients agree to release and hold me harmless from any liability arising from the Services provided.
11. Code of Conduct
Respectful Interaction: I strive to maintain a positive coaching environment. Clients are expected to communicate respectfully.
Termination for Misconduct: I reserve the right to terminate services without refund if a Client demonstrates inappropriate or harmful behaviour.
12. Modifications to Terms
Updates: I reserve the right to update these Terms at any time to reflect changes in my Services, operational practices, or legal obligations.
Notice: Clients will be notified of any significant changes, and continued use of the Services constitutes acceptance of the revised Terms.
13. Entire Agreement
These Terms constitute the entire agreement between the Client and Leo Alves regarding online fitness coaching services. No other verbal or written statements can modify these Terms unless agreed upon in writing by both parties.
